Terms & Conditions for Austin Restaurant Weeks Passport

HOW TO ENTER:

During the Entry Period, each eligible Participant can enter the Contest by visiting any of the restaurants listed on the Austin Restaurant Weeks website, receiving a sticker from the restaurant, and affixing the sticker to the Participant’s passport to complete the listed challenges. In order to participate, each eligible Participant will need the ARW passport and a valid photo ID. Participants may eat at same restaurants more than one time during August 16 – September 3rd and receive a passport sticker each time. Entries do not need to be unique, unless challenge requires unique restaurant visits. A Participant may only turn in the Participant’s passport for a prize once.

False Fraudulent or Deceptive Entries or Acts: Participants who, as determined by Sponsors in their sole discretion, provide false, fraudulent or deceptive entries or who engage in false, fraudulent or deceptive acts in connection with the Contest will be disqualified. Sponsors, in their sole discretion, further reserve the right to disqualify any person for: (i) tampering with the entry process or the operation of the Contest; (ii) gaining an unfair advantage in participating in the Contest; (iii) obtaining winner status using false, fraudulent or deceptive means; or (iv) engaging in otherwise unsportsmanlike, disruptive, annoying, harassing, or threatening behavior.

TERMS AND CONDITIONS:

Use of personal information: By entering this contest, you agree that the Central Texas Food Bank may add your e-mail address to its e-newsletter list. The Central Texas Food Bank will not sell or share your contact information with any other entity.

Eligibility: This contest is only open to legal residents of the United States who are at least 18 years of age. Contest packages containing alcoholic beverages may only be won by patrons who are at least 21 years of age or older. In addition the Central Texas Food Bank may remove from eligibility (including removal of any hashtags from) any entrant who has violated any law, rule or regulation, tampered with the operation of the contest or engaged in any conduct that the Central Texas Food Bank finds offensive or inappropriate, in its sole discretion.

Claiming Prizes: You must contact the Central Texas Food Bank directly to claim your prize and coordinate a mutually agreed date and time to pick up your prize. All prizes must be claimed by December 31st, 2018.

Limit one (1) prize per Participant per challenge. All taxes, fees, and surcharges on prizes are the sole responsibility of the Participants. Participants will be issued an IRS Form 1099 for the fair market value of the prizes inclusive of sales or other transaction taxes if total prizes exceeds $600. Affidavit of eligibility (including SSN), prize acceptance form, tax information, assignment of rights, personal services agreement, publicity release, and/or mutually acceptable liability releases may be required where not prohibited. Any and all guarantees and warranties for merchandise prizes are subject to the manufacturer’s and/or service providers terms and conditions, and winner agrees to look solely to such manufacturers and/or service providers for any warranty or guarantee claim. Prizes are non-transferable except in the sole discretion of the Sponsors. No substitution or cash equivalent is allowed. Sponsors reserve the right to substitute prizes of the same approximate retail value. Prizes consists only of items specifically listed as part of the prize. All costs and expenses not specified herein, related to any prize, including but not limited to delivery, installation, service activation fees, and other expenses incurred by accepting the prize, are the sole responsibility of the Participants.

Miscellaneous: Odds of winning a prize depend on the number of eligible entries received. Winners will be selected on first come, first served basis. Entrants agree to be bound by these contest rules and by the decisions of the Central Texas Food Bank, which are final and binding. The Central Texas Food Bank reserves the right to change these rules at any time, in its sole discretion and without prior notification, and to suspend, cancel, postpone or extend the contest for any reason. This contest is open to the public, including Central Texas Food Bank volunteers. Central Texas Food Bank board members, employees and family members are not eligible.

RELEASE OF LIABILITY AND INDEMNIFICATION:

As consideration for entering the Contest, all Participants agree, to the maximum extent permitted by applicable law, to RELEASE, DISCHARGE AND COVENANT NOT TO SUE Central Texas Food Bank, participating prize sponsors, the other Contest Entities (as described above) and each of their respective direct and indirect affiliates, divisions, parent and subsidiary companies, officers, employees, shareholders, representatives, managers, members, directors, owners, agents, insurers, attorneys, predecessors, successors, and assigns thereof (collectively, the “Released Parties”), from and against all claims, damages, charges, injuries, losses, proceedings, suits, actions (including but not limited to tort actions, product liability actions, wrongful death actions, warranty actions, breach of contract actions, privacy and defamation actions, misappropriation of likeness actions, identity theft, loss of consortium claims), expenses and attorney fees that they or anyone on their behalf (including but not limited to their heirs, representatives or next of kin) have or might have for any death, injury, damage or claimed injury or damage arising out of, involving or relating to their participation in the Contest, INCLUDING, BUT NOT LIMITED TO, ANY CLAIM THAT THE ACT OR OMISSION COMPLAINED OF WAS CAUSED IN WHOLE OR IN PART BY THE STRICT LIABILITY OR NEGLIGENCE IN ANY FORM OF THE RELEASED PARTIES.

Additionally, as consideration for entering the Contest, all Participants agree, to the maximum extent permitted by applicable law, to INDEMNIFY, HOLD HARMLESS, AND DEFEND the Released Parties in any action or proceeding from and against all claims, damages, charges, injuries, losses, proceedings, suits, actions (including but not limited to tort actions, product liability actions, wrongful death actions, warranty actions, breach of contract actions, privacy and defamation actions, misappropriation of likeness actions, identity theft, loss of consortium claims), expenses and attorney fees that they or anyone on their behalf (including but not limited to their heirs, representatives or next of kin) have or might have for any death, injury, damage or claimed injury or damage arising out of, involving or relating to their participation in the Contest or for their failure to comply with the terms of the above release provision. THIS AGREEMENT TO INDEMNIFY, HOLD HARMLESS AND DEFEND APPLIES EVEN IF THE ACT OR OMISSION COMPLAINED OF WAS ALLEGEDLY CAUSED IN WHOLE OR IN PART BY THE STRICT LIABILITY OR NEGLIGENCE IN ANY FORM OF THE RELEASED PARTIES.

PUBLICITY RELEASE:

Unless prohibited by applicable law, Participants authorize and irrevocably grant to the Central Texas Food Bank permission to, from time to time, reference and discuss Participants and their participation in the Contest in its print publications and/or on its website(s) in photographs, video recordings, digital images, audio recordings, as well as in newsletters, news releases, other printed materials, and in materials made available on the Internet or in other media now known or hereafter developed for any purpose the Central Texas Food Bank deems proper. Such reference and discussion may involve Participants’ name and other personal/biographical material.

Terms & Conditions for Participating Restaurants

Austin Restaurant Weeks and participating restaurants cannot guarantee that specific menu items shown on this site will be available at all times. Due to supply and demand, substitutions of similar value and deliciousness may be offered.

Reminder For Restaurant Goers & ARW Participants

If you partake of the cocktail or beer options, please don’t drink and drive. One alternative is to use a ride share service, such as RideAustin, which allows you to round up your fare to the nonprofit of your choice, like maybe the Central Texas Food Bank.
